Please read these Terms of Use carefully before using our apps and related services (“Service" or “App”) developed and operated by Laser Chess Federation. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

1. Minimum Age & Eligibility

By using the Service, you represent and warrant that you are at least 13 years of age. If you are under the age of 18 (or the age of majority in your jurisdiction), you may only use the Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

2. Intellectual Property Rights

All visual media presented by using this app is owned and/or licensed by Laser Chess Federation and is provided as part of our service to our users. The application itself, its source code, and its design are the exclusive property of Laser Chess Federation and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Laser Chess Federation.

3. Scope of License

Laser Chess Federation grants to you a nontransferable, non-exclusive license to use the Licensed Application on any supported devices that you own or control. For Apple-branded products, this is subject to the Usage Rules set forth in the Apple Media Services Terms and Conditions. This license does not allow you to use the Licensed Application on any device that you do not own or control, and you may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time. You may not copy, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application.

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("User Content"). You are responsible for the User Content that you post to the Service, including its legality, reliability, and appropriateness. By posting User Content to the Service, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such User Content on and through the Service.

You may not access or use the Service for any purpose other than that for which we make the Service available. The Service may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. Prohibited activities include, but are not limited to: scraping or data mining; interfering with or disrupting the Service; attempting to bypass any measures of the Service designed to prevent or restrict access; and using the Service in any manner that violates any applicable law or regulation.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Laser Chess Federation makes no representations or warranties of any kind, express or implied, as to the operation of the Service or the information, content, or materials included therein. To the full extent permissible by applicable law, Laser Chess Federation disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

8. Limitation of Liability

In no event shall Laser Chess Federation, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service. In no event shall Laser Chess Federation’s aggregate liability for all claims related to the Service exceed $50.00.

9. Dispute Resolution & Binding Arbitration

Please read this section carefully. It affects your rights, including your right to file a lawsuit in court.

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration in Richmond, Virginia, before one arbitrator. The arbitration shall be administered by JAMS pursuant to its Streamlined Arbitration Rules and Procedures. Judgment on the Award may be entered in any court having jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction.

Class Action Waiver: You and Laser Chess Federation agree that any arbitration shall be conducted in their individual capacities only and not as a class action or other representative action, and you and Laser Chess Federation expressly waive their right to file a class action or seek relief on a class basis.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
